Rules for the conduct of the Hobart Showground Market

These Rules have been developed to ensure the proper operation of the Hobart Showground Market.  They affect all Stallholders who participate, with specific application to Permanent Stallholders and any other Stallholder who may access or store their goods at Hobart Showground.  Failure to comply with Rules and multiple offences (3) will result in withdrawal of Stallholder status and resultant benefits.

Our Market Mission is to provide;
Hobart Showground Market; an accessible peoples Market offering a wide variety of goods and bargains in a fair, friendly, affordable, and easy to do business with environment.

  1. STALLHOLDER STATUS
    Stallholders come under several classes;

    Permanent Stallholders; those that book a permanent site and take on the commitment to pay rental weekly (be that in advance or by the day) and are obligated to make payment for that stall whether in attendance or not.  Sites allocated to Permanents are done so on the basis that the site will remain theirs to use as long as they conform to the code, and make their payments on time.  The only exception to this rule is if an area of the Market is being re-developed and in such instances an alternative site would be offered at similar space and cost.  If a Permanent Stallholder anticipates that they may be absent from the Market in advance they should advise Market Management, remove goods and return the site to the Casual Pool for the duration.  On return Stallholder would resume status as Permanent with all conditions enjoyed previously.

    Regular Stallholders;
    those that come with regular frequency, i.e. weekly or monthly, or booked in advance for designated times over a period of a year, or on a seasonal basis.  Their sites may be moved from time to time, but the status quo of returning to their chosen site will be preserved wherever possible.

    Casual Stallholders;
    are those that book intermittently and are allocated a site on availability.

  2. STALLHOLDER PENALTIES
    Penalties have been implemented as a method of discouraging offences against these rules and will if enacted, be added to your weekly rental cost.  Continued offences (more than three) or non-payment of penalties will result in loss of your site and your right to trade in the Market.  These penalties are enforced to ensure the best result for the customers of the Market and all Stallholders comfort and ability to trade.

    Seagulls – harassment of casual stallholders prior to opening time.
    Our greatest complaint from casual stallholders is that they do not have time to set up before being descended upon by early shoppers (seagulls), quite often our own Permanent Stallholders.  Penalties $50 per offence. 

    Parking Areas for Stallholders
    The designated parking area for Stallholders is the Spurline Road that runs along the back of the Market Building towards the Brooker Highway.  Inside Stallholders who access the building from the rear should park behind the building allowing room to enter doors and loading door.  Outdoor Stallholder that are not permitted to leave their vehicles on their site, and indoor Stallholders that access the building from the front are required to park on the Spurline Road beyond the enter past the Woodchop area.
    Penalties for parking in Customer Parking areas $20 per offence. 

    Overstepping Boundries

    Boundaries on indoor sites are well defined. Stallholder’s goods must not exceed the area.  Reconfigure your stall within the boundaries to get the maximum usage.  The most common offence is infringing on customer walkway areas.
    Penalties for overstepping your boundary $20 per offence. 

    Trading Hourse - Non-Attendence
    Permanent Stallholders are required trade at their stall for the designated trading hours of the Market, 8am through to 2pm each Sunday. Late opening and early close, unless agreed, or notified because of illness etc, will incur a penalty.
    Penalty $20 per late to open or early to close.

    Late Payment of Weekly Rents

    All Permanent Stallholder rent must be paid on the day of the Market. Late payment will incur a penalty, unless special circumstances prevail.

    $5 penalty added to rent each week till debt cleared.

    Other offences against these rules may incur a penalty or dismissal from Market.

  3. MARKET OPERATING HOURS

    Bump in for Stallholders will commence from 6.00am, access to the site before this time is prohibited under the Planning Permit issued by Glenorchy City Council
    Public Access is limited to the hours between 8.00am till 2.00pm
    Bump out and closure of Market site by 3.00pm

  4. STALLHOLDER ACCESS AND PARKING
    All Stallholders will enter the site from the Howard Road entry adjacent to the Market Pavilion.

    Indoor Stallholders will drive their vehicle as directed to the nearest doorway, offloading their goods quickly and efficiently and remove their vehicle to designated Stallholder Parking in the Spurline Road no later than 8.00am.

    Outdoor Stallholders will be directed to their site, where they will park their vehicle as part of their stall space, if so booked, or off load and move vehicle to designated Stallholder Parking in the Spurline Road.

    Vehicles may not be moved within the Market area between the hours of 8.00am and 2.00pm.  The only exceptions are; emergency service, Market Management vehicles, or Stallholder vehicle if directed or allowed and escorted by Market Management.  Failure to comply will result in cancellation of Stallholder access to site.
    All Stallholders parking is on the Spurline Road, unless a particular parking space is designated at an outdoor site.  Stallholders may not interfere or take up designated customer parking.Failure to comply with this rule will jeopardize our Council Permit to operate and will result in removal of Permanent Stallholder Status and incur penalties as outlined above.
  5. STALLHOLDER IDENTIFICATION
    All Stallholders (permanent, regular or casual) must have on hand at any time a driver’s license or similar documentation to enable identification by the Public or authorities.
  6. FOOD LICENSES
    No food whatsoever (including wrapped lollies or cans of cordial or similar) can be sold at the Market unless the Stallholder has on display a current Food Permit issued by the Glenorchy City Council.  For details contact the Glenorchy Council Environmental Health Officer 62166797.
  7. SECOND HAND ITEMS
    The Second-hand Dealers and Pawnbrokers Act 1994 requires Stallholders to keep records for goods with a value greater than $50. Particulars required; who you bought or received the goods from, their contact details, and the date of purchase.
  8. ELECTRICAL APPLIANCES
    All electrical items for sale must be tagged UNTESTED, or if tested noted as TESTED with the testing date, expiry date and license number of the tester.

    Where Stallholders link electrical appliances to Market Power Supply, such supply must be tagged as TESTED with the testing date, expiry date and license number of the tester.  Failure to do so will result in disconnection of power supply and/or withdrawal of Permanent Stallholder status.  The electrical supply in the building will not support radiators, blow heaters and kettles.

  9. ALTERATIONS OR DAMAGE TO BUILDING, GROUNDS, SURFACES

    Stallholders are not permitted to affix or attach, or damage any surface of the market building or surrounding area without the expressed permission of Market Management.

    Any approved fixture must be removed at such time that the Stall is quit, or in annual bumpout for the Royal Hobart Show.

  10. CUSTOMER SERVICE AND DEALING WITH COMPLAINTS

    We all know that ‘the customer is always right’, but we also know it is never as simple as that.   Market Management will always take the view that if a customer bought something then that item should be as it has been represented and we would expect that the Stallholder should be ready refund or make good such a complaint. The bottom line is that you may win in the short term by giving lesser than good customer service, but on the whole the Market will loose.  If we receive complaints from customers we will always relay them to you for your resolution before taking any action on our own part.

  11. STORAGE OF STALLHOLDERS GOODS

    Storage of Stallholders Goods at that Stallholders designated Permanent Space is at the stallholder’s risk. Market Management does not take on any liability for Stallholders goods whatsoever, including theft, damage caused by entry of the elements to the building, fire or damage that might result in damage to goods or the inability of the Market to operate.

    NB. Stallholders should undertake their own insurance, which may cover their goods while within the Market, in transit between the Market and any other place of storage or trade.

  12. ACCESS TO MARKET BUILDINGS OUTSIDE OPERATING HOURS
    Access to Market Buildings only through pre-arrangement with Market Management (fees may apply).
  13. FIREARMS AND SALE OF DANGEROUS OR PROHIBITED ITEMS

    Sale of Firearms of any type including children’s toys (projectile type) and guns is prohibited.
    Sale of any sort of knife (including pocketknives) to a minor is illegal.
    Sale of illicit drugs or alcohol is illegal and will be reported to authorities
    Sale of cigarette lighters to persons under the age of 18 is not permitted

  14. SALE OF ANIMALS

    Sale of Animals on site IS NOT PERMITTED unless by written permission from Market Management.

  15. PUBLIC LIABILITY

    As part of the running of the market we cover all stallholders ‘for their legal liability against bodily injury or damage to property of third parties as a result of an occurrence caused by the negligence of the stallholder.’   This does not include cover for product liability, or cover for food outlets or carnival type rides, these operators must provide proof of both public and product liability.  If in doubt you should contact your insurance agent to ensure you are adequately covered.

  16. COMPETITIONS

    Promotional competitions conducted by Market Management or the Market Stallholders Promotion Group (with the exception of the ‘Weekly Stallholder Raffle’ or where specifically stated) ARE NOT TO BE ENTERED INTO BY STALLHOLDERS OR THEIR WORKERS.  These promotions are designed to build our customer base, not for the amusement or direct benefit of Stallholders.

  17. WEEKLY STALLHOLDER RAFFLE

    The Promotion Group holds a Stallholders Raffle each week with the winning Stallholders sharing in the funds raised.  Identified Ticket Sellers sell tickets.  Results are advised no later than 1pm on the day of sale.  No other raffles are permitted without the written permission of Market Management. Surplus funds are managed by Stallholders Promotion Group for special promotions. The Promo Group meets monthly.

  18. STALLHOLDERS PROMOTION GROUP

    On an annual basis nominations are invited from Stallholders to represent the Market on promotional and marketing ideas to improve the Market.  The Group also controls the Stallholders Raffle retaining funds that it uses to undertake particular promotions.  The Promotion Group meets monthly or as required.

  19. LOST PROPERTY

    All lost property to be handed into Lost Property Point (Mercury Stall just inside main door) where items will be register and where possible owners located.

  20. POSITIVE STALLHOLDERS

    Any market is only as good as the people involved in delivering the ‘market experience’, and that experience will best be promoted by a ‘positive attitude’ from all our stallholders.  If any stallholder has any issues they should bring them to the notice of Market Management.

  21. STALL FEE REVIEWS

    Stall fees are reviewed annually with new rates applicable from the 1st April each year.  The new rate is calculated considering the current rate a Stallholder enjoys, and major works or activities that have been/will be undertaken to improve both Market business and infrastructure, and the CPI for the previous 12 months. The CPI adjustment is calculated on the previous years Casual Rates.

  22. AGREEMENT TO ABIDE BY RULES
    An abbreviated copy of these Rules is published weekly on Stallholder Newsletter.  The full Rules are displayed at the Market Office area within the Indoor Market and on the Market Website http://www.hobartshowground.com.au/market/rules.php, or a copy of these rules can be obtained from Market Management.

    It is the Stallholders responsibility to be aware of, and to abide by these Rules.
